Women’s Cases Before Courts in Lebanon: A Structural Analysis of Justice and Protection Pathways

In this study, we examine Lebanon’s personal status system as it is today:

A sectarian legal system governed by multiple authorities, where divorce, child custody, alimony, guardianship, and protection orders often become lengthy, costly, and exhausting legal processes, resulting in structural inequalities in women’s access to justice and protection.

Through a qualitative analysis based on in-depth interviews with lawyers, judges, and survivors, alongside a review of court files and judicial decisions, the study demonstrates how the dual court system, the absence of unified legal standards, and the overlap between religious and civil authorities undermine equality before the law and weaken effective protection for women and children.

The study goes beyond documenting these challenges. It presents clear legislative and institutional recommendations toward a more equitable legal framework that upholds the rule of law and protects women from structural discrimination.

قضايا النساء أمام المحاكم في لبنان: تحليل بنيوي لمسارات العدالة والحماية

:في هذه الدراسة، نفتح ملف منظومة الأحوال الشخصية كما هي

منظومة طائفية متعدّدة المرجعيات، تُحوّل الطلاق والحضانة والنفقة والولاية وأوامر الحماية إلى مسارات طويلة، مكلفة، ومُنهِكة، وتُنتج تفاوتًا بنيويًا في الوصول إلى العدالة والحماية

من خلال تحليل نوعي يستند إلى مقابلة معمّقة مع محامين/ات وقضاة وناجيات، إضافة إلى مراجعة ملفات وأحكام قضائية، تكشف الدراسة كيف تؤدي ازدواجية المحاكم، وغياب المعايير الموحّدة، وتداخل السلطات الدينية والمدنية إلى إضعاف مبدأ المساواة أمام القانون وتقويض الحماية الفعلية للنساء والأطفال

لا تكتفي الدراسة بالتشخيص، بل تطرح توصيات إصلاحية واضحة نحو إطار قانوني أكثر عدلًا، يضمن سيادة القانون، ويحمي النساء من التمييز البنيوي
